Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the websites operated by Lost Anchor Rentals LLC (“Lost Anchor,” “we,” “us,” “our”), including lostanchors.com, lostanchorrentals.com and lostanchor.rentals, our booking portal, text messages, kiosks/racks, equipment, and related services (collectively, the “Services”). By using the Services, you agree to these Terms.  If you do not agree, do not use the Services.

1. Eligibility & Accounts

  • You must be at least 18 to rent. A Waiver must be signed for each participant.  Parents must sign a waiver for each child under 18.  Minors may participate only with a parent/guardian who is the renter of record and present during use.  Children 6 an under are not allowed.

  • You agree to provide accurate information and keep it current.

  • We may refuse, suspend, or cancel access at our discretion (e.g., safety, nonpayment, misuse).

2. Booking, Access Codes & Self-Service

  • Reserve ahead on our website or scan the on-site QR to book.

  • A few minutes before your start time, we send a texted access code to unlock your locker/bay.

  • You are responsible for keeping codes secure and returning all gear to the same location before your rental end time.

3. Mandatory Safety Acknowledgments

  • During checkout, you must: (a) review posted Safety Tips, (b) watch the mandatory safety video, and (c) accept the digital waiver/assumption of risk.

  • If you disagree with any safety requirement, do not proceed with the rental.

4. Equipment & Required Use

  • Rentals include: kayak or SUP, USCG-approved PFD (life jacket), adjustable paddle, and (for packable units) pump and SUP leash.

  • PFDs must be worn as required by law or policy. No alcohol/drug use while paddling.

  • You must use equipment as instructed, keep it within posted areas, and follow local rules (e.g., right-of-way, no-wake zones).

5. Fees, Pre-Authorizations & Payments

  • You authorize us and our payment processor to place a temporary pre-authorization/hold on your payment method and to charge rental fees, taxes, and any applicable adjustments (see Sections 6–8).

  • You agree to pay all amounts incurred under your account. If a payment fails, you remain responsible for amounts due.

6. Returns, Late Time & Extensions

  • Return all items to the same location and close out on your phone by your end time.

  • If you need more time, extend in the app (subject to availability) before your end time.

  • Late returns may incur per-minute or per-interval charges up to the value of an additional rental period.

7. Loss, Damage & Cleaning

  • You are responsible for equipment from unlock to confirmed return.

  • Damage, loss, or missing items (including paddles, pumps, leashes, or PFDs) may be charged at replacement cost plus reasonable service fees.

  • Excessive cleaning (e.g., mud/sand packed inside valves/compartments) may incur a cleaning fee.

8. Cancellations, Weather & Closures

  • You may cancel or modify in the booking portal subject to the site policy shown at checkout.

  • For unsafe conditions (e.g., lightning, high winds, poor visibility), we may pause or close operations and will offer a rebook or refund per the posted policy.

  • We are not responsible for conditions beyond our control (tides, wind shifts, beach access changes, public advisories).

9. Prohibited Conduct

You agree not to:

  • Share access codes, sub-rent, or use equipment after your end time.

  • Paddle under the influence of alcohol/drugs or without required PFDs.

  • Enter restricted zones, ride wakes, or endanger others/wildlife.

  • Modify equipment or use it for stunts, races, or towing.

  • Remove equipment from the general launch area if prohibited on-site.

10. Accessibility

We place kiosks with ADA-conscious approaches and reachable controls, and our mobile flow supports assistive technologies. If you need assistance or an accommodation, contact Support before your start time.

11. Assumption of Risk; Release

Water activities carry inherent risks, including drowning, collision, weather, currents, and equipment failure. You understand and voluntarily assume all risks arising from participation, whether foreseeable or not, and agree to the waiver and release presented during checkout, to the maximum extent allowed by law.

12. Disclaimers

THE SERVICES AND EQUIPMENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND QUIET ENJOYMENT. We do not guarantee condition suitability, uninterrupted access, or error-free operation.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER LOST ANCHOR NOR ITS OWNERS, OFFICERS, EMPLOYEES, OR AGENTS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS/REVENUE/GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF: (A) US$500 OR (B) THE AMOUNTS YOU PAID TO US FOR THE RENTAL AT ISSUE.

14. Indemnification

You agree to indemnify, defend, and hold harmless Lost Anchor and its affiliates from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your: (a) use or misuse of the Services or equipment; (b) violation of these Terms or applicable law; or (c) infringement of any rights of a third party.

15. Text Messaging & Communications

By providing a mobile number, you consent to receive transactional SMS (access codes, confirmations, reminders, support). Message/data rates may apply. Reply STOP to opt out of non-essential texts; you may still receive critical messages tied to an active booking.

16. Privacy

Our Privacy Policy explains how we collect and use personal information. By using the Services, you consent to those practices.

17. Intellectual Property

The Services, including content, logos, videos, and signage/graphics, are owned by or licensed to Lost Anchor and are protected by law. You may not copy, modify, or distribute them except as permitted in writing.

18. Third-Party Services

We use third-party providers for payments, messaging, hosting, and analytics. Your use of those components may be subject to their terms and privacy policies.

19. Changes to the Services or Terms

We may update the Services or these Terms at any time. Material changes will be posted with a new “Last updated” date. Continued use after changes means you accept the updated Terms.

20. Governing Law; Dispute Resolution

These Terms are governed by the laws of the State of Florida, without regard to conflict of laws.
Arbitration & Class Action Waiver. Except for small-claims court or injunctive relief, you agree that any dispute with us will be resolved by binding arbitration on an individual basis, and not as a class action or representative proceeding. If you do not wish to arbitrate, you may opt out within 30 days of your first use by emailing legal@lostanchors.com with your name, phone, and a clear statement of opt-out. Venue for any permitted court action will be Pinellas County, Florida.

21. Force Majeure

We are not liable for delays or failures due to events beyond our reasonable control (e.g., weather, acts of God, labor disputes, power/internet failures, government actions).

22. Termination

We may suspend or terminate access immediately for safety, fraud, nonpayment, or breach. Sections that by their nature should survive (e.g., fees, disclaimers, limitations, indemnity, dispute resolution) survive termination.

23. Miscellaneous

  • Severability. If a provision is unenforceable, the remainder stays in effect.

  • No waiver. Our failure to enforce a provision is not a waiver.

  • Assignment. You may not assign these Terms; we may assign as permitted by law.

  • Entire agreement. These Terms plus policies referenced herein are the entire agreement between you and us regarding the Services.
